Is the FBI Using Smartphone Spyware For Law Enforcement Purposes?

The narrative continues over smartphone privacy issues involving the data logging program Carrier IQ, which was recently found to be installed on about 150 million handsets worldwide, including many popular Android, iOS, Nokia, and Blackberry devices. Controversy over the invasive software stemmed from allegations that Carrier IQ has the ability to record an array of device information, including keystrokes, text messages, web browsing, and user location, all without the user’s knowledge or expressed consent.
Uproar over the smartphone "spyware" emerged in late November when Trevor Eckhart posted on his blog two videos unraveling how the Carrier IQ program he discovered on an HTC smartphone was able to track virtually every function on the phone. Following Eckhart’s purported revelation, several cellphone providers, including Sprint, T-Mobile, and AT&T, admitted they have used the program on their phones for performance-tracking purposes.
In turn, the software developer and several cellphone providers have been issued a class action lawsuitfor violating the Federal Wiretap Act, the Stored Electronic Communications Act, and the Federal Computer Fraud Abuse Act. The filing alleged that the companies committed an "unprecedented breach in the digital privacy rights of 150 million cell phone users" and that the defendants deliberately pre-installed the Carrier IQ software into their products, without any form of consumer disclosure.
As previously reported by The New American, the four consumers who commenced the lawsuit sought compensatory and punitive damages on behalf of all other consumers whose devices contain the spyware program, and the complaint requested that damages of $100 a day per violation should be granted to those affected. AT&T and Sprint quickly released statements explaining that the data extracted through the Carrier IQ program is exclusively used to improve service performance; likewise, Apple admitted to using the program on its iOS devices, but assured that future updates will fully eliminate the program.
However, new information regarding the debacle has provoked speculation of whether the FBI is using the software for law enforcement purposes, after a Freedom of Information Act (FOIA) request filed by Michael Morisy of MuckRock News, a proxy website for filing FOIA requests, shed new light on the controversy:
A recent FOIA request to the Federal Bureau of Investigation for "manuals, documents or other written guidance used to access or analyze data gathered by programs developed or deployed by Carrier IQ" was met with a telling denial. In it, the FBI stated it did have responsive documents — but they were exempt under a provision that covers materials that, if disclosed, might reasonably interfere with an ongoing investigation….
What is still unclear is whether the FBI used Carrier IQ's software in its own investigations, whether it is currently investigating Carrier IQ, or whether it is some combination of both — not unlikely given the recent uproar over the practice coupled with the U.S. intelligence communities reliance on third-party vendors. The response would seem to indicate at least the former, since the request was specifically for documents related directly to accessing and analyzing Carrier IQ data.

Atheist Messages Displace California Park Nativity Scenes

Atheist Messages Displace California Park Nativity Scenes

Atheist messages have displaced most of the Christmas nativity scenes that local churches had placed in a California park for nearly six decades, and the churches say it was a coordinated attack.
Local churches have traditionally claimed 14 of the 21 display spaces to illustrate the story of the birth of Jesus Christ.
But atheists got all but three of the spaces this year because of a new lottery system.

Newt Gingrich: Selling Access

 You Tube
 Dec 11, 2011

The Ron Paul 2012 Presidential campaign announced today the release of its latest ad, 'Selling Access', another two-minute web video aimed at former House Speaker Newt Gingrich, calling him out as a corrupt Washington insider who got rich through influence-peddling.

The video, which the campaign plans to promote prominently on conservative web sites, includes a clip of Gingrich calling himself an 'insider' and another in which the former Speaker brags about getting paid $60,000-a-speech. The video comes after the viral success of Paul's earlier web ad, 'Serial Hypocrisy', which criticizes Gingrich for many of the same issues.

Ron Paul: Defense Bill Establishes Martial Law In America

Top tier presidential candidate Ron Paul has decried the ‘indefinite detention’ provision of the National Defense Authorization Act, warning that it represents an arrogant, bold and dangerous attempt to establish martial law in America.

Speaking with the Alex Jones Show today, Congressman Paul went on the offensive against the bill, which is set to be signed into law by President Obama later this week.

Section 1031 of the NDAA bill, which itself defines the entirety of the United States as a “battlefield,” allows American citizens to be snatched from the streets, carted off to a foreign detention camp and held indefinitely without trial. The bill states that “any person who has committed a belligerent act” faces indefinite detention, but no trial or evidence has to be presented, the White House merely needs to make the accusation.

Paul said he saw significance in “the announcement and the arrogance of it all,” making reference to the Obama administration’s claim that it can now assassinate American citizens anywhere in the world and noting that the passage of the NDAA bill is an effort to codify the policy into law.

“This is a giant step – this should be the biggest news going right now – literally legalizing martial law,” said Paul, noting that the subject did not come up at all in any of the Republican debates.

The Congressman also decried the “arrogance” of an attempt to push through via a voice vote an amendment that would have still authorized indefinite detention even if a detainee was found innocent after a trial. The amendment was narrowly defeated by his son, Senator Rand Paul.

“This is big,” emphasized Paul, adding “This step where they can literally arrest American citizens and put them away without trial….is arrogant and bold and dangerous.”
Despite speculation that the Obama administration would veto the bill, it emerged yesterday that it was the White House itself which worked to remove language from the bill that would have protected American citizens from indefinite detention under Section 1031.
The administration has been working with lawmakers to alter a separate provision, Section 1032, which pertains to the military being required to take custody of individuals.
With the administration’s concerns over Section 1032 now largely resolved, a revised and final version of the bill could be signed into law before the end of the week.
Republican Congressman Justin Amash has again warned that lawmakers are attempting to mislead the American people by claiming U.S. citizens are exempt from the most dangerous provisions of the bill.
“Pres. Obama and many Members of Congress believe the President ALREADY has the authority the bill grants him. Legally, of course, he does not. This language was inserted to keep proponents and opponents of the bill appeased, while permitting the President to assert that the improper power he has claimed all along is now in statute,” writes Amash.
“They will say that American citizens are specifically exempted under the following language in Sec. 1032: “The requirement to detain a person in military custody under this section does not extend to citizens of the United States. Don’t be fooled. All this says is that the President is not REQUIRED to indefinitely detain American citizens without charge or trial. It still PERMITS him to do so,” warns the Congressman.
Amash is encouraging Americans to contact their representatives and sign a petitionexpressing their opposition to the NDAA bill, calling it “one of the most anti-liberty pieces of legislation of our lifetime.”

Police employ Predator drone spy planes on home front

Armed with a search warrant, Nelson County Sheriff Kelly Janke went looking for six missing cows on the Brossart family farm in the early evening of June 23. Three men brandishing rifles chased him off, he said.

Janke knew the gunmen could be anywhere on the 3,000-acre spread in eastern North Dakota. Fearful of an armed standoff, he called in reinforcements from the state Highway Patrol, a regional SWAT team, a bomb squad, ambulances and deputy sheriffs from three other counties.

He also called in a Predator B drone.

As the unmanned aircraft circled 2 miles overhead the next morning, sophisticated sensors under the nose helped pinpoint the three suspects and showed they were unarmed. Police rushed in and made the first known arrests of U.S. citizens with help from a Predator, the spy drone that has helped revolutionize modern warfare.

But that was just the start. Local police say they have used two unarmed Predators based at Grand Forks Air Force Base to fly at least two dozen surveillance flights since June. The FBI and Drug Enforcement Administration have used Predators for other domestic investigations, officials said.

"We don't use [drones] on every call out," said Bill Macki, head of the police SWAT team in Grand Forks. "If we have something in town like an apartment complex, we don't call them."

Rand Paul Warns GOP Voters: Gingrich, Romney Are Not Conservatives

JOE WOLVERTON, II
New American
Monday, December 12, 2011
Senator Rand Paul, a self-described representative of the Tea Party, worries that the small progress toward the restoration of limited government may be “set back” by the upcoming Republican presidential nomination.

In a letter to the Des Moines Register, the son of GOP White House hopeful Ron Paul set forth his two goals for striving to protect the “conservative movement” from being hampered by the nomination of a candidate with “a different set of ideas and values.”
The first of Senator Paul’s two goals is to “prevent the European debt crisis from consuming America next.” Although certainly a priority for the Senator, the rest of the letter is devoted to details of his second goal: electing a “constitutional[ly] conservative president in 2012.”
An urgent issue for the Republican Party and the United States is the election of a president who will remain faithful to his Oath of Office from the moment his hand is placed on the Bible on Inauguration Day.
While Senator Paul admits that anyone on the current roster of Republican candidates would be an improvement over Barack Obama, he calls out the two men leading in the polls — Mitt Romney and Newt Gingrich — for not representing “the tea party, the conservative movement, or the type of change our country desperately needs….”
In his indictment of the former Governor of Massachusetts and the former Speaker of the House, Paul’s first charge against both is their support for the $700-billion bank bailouts signed into law by President George W. Bush in 2008.
Paul quotes the Obama Treasury Department as describing the bailouts, officially called the Troubled Asset Relief Program (TARP), as “one of the most unpopular government programs in American history.”
